Bargain Pleas In Indian Justice System
BARGAIN PLEAS can be useful for the Indian legal system which is now struggling to find its feet, because of corruption in Police, law fraternity, judiciary etc. Also, the inordinate delays in rendering justice can be remedied.
My suggestions are - first enlarge the existing punishment scales substantially for all offences and, provide that if the accused enter a plea of guilty at the outset, scale down the punishment based on the old punishment scales. Lawyers cannot play monkey-tricks with the system, the society will get faster justice, the accused will have a better deal and the Govt. will save a lot of money. Second, many other related laws will need close re-look.
Bargain-plea has worked in Europe, USA, UK and other countries following democratic system. My first impression is that India badly needs this to re-order its justice-delivery-system and to handle corruption at high levels.
